Please read these Terms of Use carefully before using the Health Atlas MD website (the "Site"). By accessing or using this Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

These Terms govern your use of our website and general interaction with Health Atlas MD online. They are separate from the patient agreements, consent forms, and financial agreements you will be asked to review and sign before receiving any medical services. In the event of a conflict between these Terms and your signed patient agreements, your patient agreements will control with respect to clinical care.

1. No Physician-Patient Relationship

Visiting or using this website, completing a contact or assessment form, or communicating with our staff does not create a physician-patient relationship between you and Dr. Amin Mery, MD, or Health Atlas MD.

A physician-patient relationship with Health Atlas MD is established only when Dr. Mery has conducted a comprehensive in-person or authorized telehealth evaluation, reviewed your health history and relevant diagnostic information, and expressly agreed in writing to provide you with ongoing medical care. Until that relationship is established, any information provided by Health Atlas MD, through this website or otherwise, does not constitute medical advice or treatment.


2. No Medical Advice

The content on this website — including information about health conditions, symptoms, treatment approaches, IV infusions, peptide therapies, supplements, protocols, and any other health-related topics — is provided for general informational and educational purposes only. It is not intended to be, and should not be interpreted as, medical advice, medical diagnosis, or a recommendation for any specific treatment or course of action.

Do not use content from this website to self-diagnose or self-treat. Before beginning, modifying, or discontinuing any treatment, medication, supplement, or health protocol, always consult with a qualified, licensed healthcare provider who has examined you and is familiar with your individual health history.

3. Cash-Pay Practice and Financial Policy

Health Atlas MD is a cash-pay, direct-pay medical practice. We do not accept any form of health insurance, including Medicare, Medicaid, or private insurance plans of any kind. We do not submit claims to insurance companies on your behalf. We do not provide superbills, insurance coding documentation, letters of medical necessity for insurance purposes, or any other documentation intended to support a claim for insurance reimbursement.

Payment is due in full at the time services are rendered. By scheduling an appointment or requesting services from Health Atlas MD, you acknowledge that you have read and accept this financial policy, and you agree to pay for all services rendered at the time of your visit.

Services for which you may incur charges include, but are not limited to: initial consultations, follow-up visits, laboratory testing ordered by our practice, IV infusions, injections, peptide prescriptions, supplements, and any additional diagnostic or therapeutic services provided.

We recommend consulting with your insurance provider to understand any coverage you may have for out-of-pocket medical expenses. Health Atlas MD is not responsible for any determination made by your insurance carrier regarding coverage or reimbursement.

Returned payments, disputed charges, and cancellations are subject to the terms of your signed patient financial agreement, which you will receive and be asked to sign prior to your first appointment.


4. Off-Label Use and Investigational Treatments

Health Atlas MD offers a range of treatments and protocols that reflect Dr. Mery's clinical training, decades of patient care experience, and commitment to integrative and evidence-informed medicine. These may include:

  • Peptide therapies
  • IV infusions and injection therapies
  • Supplements and nutraceuticals
  • Longevity, anti-aging, and body composition protocols
  • Immune modulation and allergy support
  • Breathing treatments and integrative therapies incorporating Ayurvedic and Eastern medicine principles

Important Regulatory Disclosure: Some treatments offered at Health Atlas MD involve therapies that are prescribed for uses not currently approved by the U.S. Food and Drug Administration (FDA), or that involve compounded preparations subject to FDA regulatory oversight. Some peptides and compounds used in integrative and longevity medicine exist in a dynamic regulatory environment, and the FDA's classifications, restrictions, and enforcement policies regarding compounded substances are subject to change.

Off-label prescribing by a licensed physician is a legal, well-established, and common medical practice in the United States. It means that Dr. Mery, exercising independent clinical judgment, has determined that a treatment may benefit your individual health condition based on his assessment, your health history, applicable clinical literature, and his professional expertise, even though the FDA has not specifically approved that treatment for that use. Off-label use does not mean a treatment is unsafe — it means the FDA has not completed a formal approval process for that specific application.

Before any treatment involving off-label use, compounded preparations, peptide therapy, or any other treatment Dr. Mery considers appropriate to disclose, you will be given a thorough explanation of the treatment, its regulatory status, known benefits and risks, and available alternatives. Your written informed consent will be obtained before treatment is administered. Your signed consent does not waive any rights under applicable law, but it does confirm that you have been informed of the nature of the treatment you are receiving.

No treatment offered at Health Atlas MD should be interpreted as FDA-approved for your specific use case unless explicitly stated in writing by our practice.


5. No Guarantee of Results

Individual health outcomes vary and are influenced by many factors outside any physician's control. Health Atlas MD makes no representations, warranties, or guarantees that any treatment, protocol, supplement, infusion, or recommendation will produce any specific health result for any individual patient.

Outcome descriptions, protocol summaries, patient-friendly descriptions of treatments, and any other content on this website reflect general information about how therapies may work and what some patients may experience. They are not guarantees of outcomes and should not be relied upon as predictions of your individual results.

Any patient experiences, references to health improvements, or descriptions of what a therapy "can do" reflect possibilities based on clinical use and available literature, not certainties. Results are highly individual and depend on factors including but not limited to your overall health status, the nature and duration of your condition, adherence to the protocol, genetic factors, lifestyle choices, and concurrent health conditions.

By participating in a telehealth service, you confirm that you are located in a state where Dr. Mery is licensed to provide care via telehealth, and that you consent to receive medical services through electronic communications.

The availability of telehealth services for specific clinical needs is at Dr. Mery's discretion. Certain services may require an in-person evaluation.

Our total liability for any direct damages arising from your use of this website shall not exceed one hundred dollars ($100.00) in the aggregate.

Nothing in these Terms limits or excludes liability for personal injury or death caused by negligence, for fraud or fraudulent misrepresentation, or for any matter that cannot lawfully be excluded under Texas law or applicable federal law, including claims arising from an established physician-patient relationship governed by applicable medical malpractice law.


12. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Health Atlas MD, Dr. Amin Mery, MD, and their respective employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or reliance on this website or its content; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party.


13. Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or your use of this website shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you hereby consent to the personal jurisdiction of those courts.


14. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this website — not including claims arising from an established physician-patient relationship, which are governed by your executed patient agreements and applicable law — shall first be subject to good-faith negotiation between the parties. If not resolved within thirty (30) days of written notice, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association under its applicable rules, conducted in Travis County, Texas, before a single neutral arbitrator. The decision of the arbitrator shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.


15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.


16. Entire Agreement

These Terms, together with our Privacy Policy and any signed patient agreements you execute with Health Atlas MD, constitute the entire agreement between you and Health Atlas MD with respect to your use of this website and supersede any prior agreements or understandings on that subject.


17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Site after the posting of revised Terms constitutes your acceptance of those changes. We encourage you to review this page periodically.
